These Terms of Service ("Terms") govern your access to and use of the Dirtroads.io website, web app, and related services (collectively, the "Service"). The Service is operated by Smart Site Services ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Safety first. Dirtroads.io is a route-planning and discovery aid, not a guarantee of road conditions, legality of access, or safety. You are solely responsible for riding, driving, or traveling safely and lawfully. See "Assumption of Risk" below.
You must be at least 18 years old, or the age of majority in your jurisdiction, to make purchases. By using the Service you represent that you meet this requirement and that the information you provide is accurate.
Dirtroads.io helps you discover unpaved roads and plan and navigate dirt-first routes. Road data is sourced from OpenStreetMap and other third parties; map imagery and basemaps are provided by MapTiler and other providers. We do not create or independently verify this data.
Off-pavement and backcountry travel is inherently dangerous. You voluntarily assume all risks associated with using the Service and with any activity you undertake using it, including injury, death, property damage, getting lost, vehicle damage, and trespass. You agree to obey all laws, posted signs, and the instructions of landowners and authorities, and to carry appropriate safety equipment and your own backup navigation.
You agree not to: (a) use the Service for any unlawful purpose; (b) scrape, resell, or redistribute map data or Service output except as permitted by the underlying data licenses; (c) attempt to circumvent the Pro paywall, security, or rate limits; (d) interfere with or overload our infrastructure or that of our providers; or (e) reverse engineer the Service except as permitted by law.
The Service, including its design, code, branding, and logos, is owned by Smart Site Services and protected by law. Map data and imagery remain the property of their respective owners (including OpenStreetMap contributors under the ODbL, and MapTiler) and are subject to their licenses and attribution requirements. We grant you a limited, revocable, non-exclusive license to use the Service for your personal, non-commercial use.
The Service relies on third parties including MapTiler (maps), OpenStreetMap (road data), Stripe and RevenueCat (payments), and "Find a Pro" link-outs to directories such as Yelp and Angi. We are not responsible for third-party services, their content, or their availability, and your use of them may be governed by their own terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that data will be accurate or current.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART SITE SERVICES AND ITS OWNERS, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, OR FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Smart Site Services from any claims, damages, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party (including trespass or property damage).
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful. You may stop using the Service at any time.
We may update these Terms from time to time. The "Last updated" date reflects the latest version. Continued use of the Service after changes take effect constitutes acceptance.
These Terms are governed by the laws of the United States and the State in which Smart Site Services is organized, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located there, and you consent to that jurisdiction.
